Terms of sale

These terms apply to the sale of listings and advertising on Red Hot Guide to venues and other businesses (the "advertiser"). The seller is Filipe Simões, Portuguese tax number 164040056, identified in the Legal notice. By paying a payment request, the advertiser accepts these terms.

1. Products

  • Verified listing: a listing with the "Verified" badge and verification date, details and hours controlled by the advertiser, a cover photo, text in Portuguese and English and contact buttons; a monthly summary of visits to the listing, sent by email.
  • Featured listing: everything in the verified listing, plus the top of the category in the city, labelled "Sponsored", up to eight photos, long text and rotation on the home page; unlimited events, published on the listing, the city page and the events page.
  • Featured event: one party or themed night, with date, time, price and link, at the top of the city and of the home page until it takes place, within the month. For venues with a verified listing.
  • Sponsorship: the line "With the support of" on a category or a city, on terms agreed in writing case by case.

2. Who may advertise

Only legal venues, with an identified business and a public address or registered office. Red Hot Guide verifies each venue before publishing and may refuse any request. It never accepts ads for escorts, prostitution, individuals or sexual services.

3. Prices

Prices are those published on the For venues page on the day the payment request is issued, with the VAT treatment shown. The payment request states the amount, the VAT where due, and the total. Chains with three or more venues get 20% off each listing.

4. Order, payment and invoice

After the advertiser's request and verification, Red Hot Guide sends a payment request with the amount and a reference. Payment is made in advance, by bank transfer, MB WAY or Revolut, to the details in the payment request, quoting the reference. The contract is formed when payment is received. The listing goes live by the working day after receipt, and the invoice is issued in the name of Filipe Simões and sent by email.

5. Term and renewal

The service lasts for the period paid, one month or one year, from activation. There is no automatic renewal: before the end, Red Hot Guide gives notice and sends a new payment request. If the advertiser does not renew, the listing loses its paid features on the day after the period ends: featured placement, the "Sponsored" label and its place ahead of unpaid listings. It may stay in the guide as a free listing, with public information, or be removed if the advertiser asks.

6. Advertiser content

The advertiser warrants that it holds the rights to the photos, texts and trademarks it provides and authorises Red Hot Guide to publish them on the site, in Portuguese and English, for the term of the contract. Content may not include nudity, promises of sexual services, identifiable people without permission or false information. Red Hot Guide may edit texts to the guide's tone and refuse or remove content that breaks these rules.

7. Featured placement and ranking

There is one featured placement per category in each city, allocated in order of payment. If the place is taken, the advertiser may join a waiting list. In lists, featured listings appear first, then paid verified listings and then the rest, as explained in the Terms of use (point 5). No advertiser can pay for any other position.

8. What the guide does not guarantee

Red Hot Guide does not guarantee a number of visits, contacts, bookings or customers, or any position in search engines or artificial intelligence assistants.

9. Suspension and termination

Red Hot Guide may suspend or remove the listing, without refund, if the advertiser stops complying with the law or these terms, for example by offering sexual services or giving false information. Before suspending or removing a paid listing, Red Hot Guide gives its reasons by email; permanent removal is notified 30 days in advance, except for serious breach or a legal obligation. The advertiser may reply and ask for the decision to be reviewed. The advertiser may end the contract at any time by email; periods already paid are not refunded, unless Red Hot Guide fails to provide the service, in which case it refunds the proportional part.

10. Right of withdrawal

These services are bought by businesses for their trade, so the consumer right of withdrawal does not apply.

11. Liability

Red Hot Guide's liability, for any cause, is limited to the amount paid by the advertiser in the last twelve months, except for wilful misconduct or gross negligence.

12. Personal data

The advertiser's contact and invoicing details are processed to perform the contract and meet tax obligations, as explained in the Privacy page. The advertiser may ask for its listing's data at any time and, as soon as the service is available, receives the listing's visit statistics. Red Hot Guide does not share one advertiser's data with other advertisers.

13. Communications

Communications are made by email, to comercial@redhotguide.pt and to the address given by the advertiser.

14. Governing law and jurisdiction

Portuguese law applies. Disputes between the parties fall under the court of the district of the seller's domicile.

15. Changes

These terms may change. Changes are emailed to advertisers with a running contract at least 15 days before they take effect; anyone who does not accept them may end the contract before that date and receives the proportional part of what they paid. Each payment request is governed by the version published on the date it is issued.
