What is legal in Portuguese adult nightlife (and what is not)

Adult nightlife in Portugal is mostly legal and licensed. The confusion comes from a line many people do not know: prostitution is not a crime, but profiting from it is. This article explains the line, category by category, and why the guide lists some things and not others. It is not legal advice.

The line: procuring

The Portuguese Penal Code punishes procuring, or lenocínio (article 169): fostering, favouring or facilitating another person's prostitution for profit. The person who sells sex commits no crime; whoever organises it, rents rooms for it, advertises it or takes commissions does. That is why there are no legal brothels in Portugal, and why the "hostess bars" that sell more than company are outside the law, however many bar licences they hold.

Red Hot Guide does not list escorts, brothels, "massages" with an ending, or personal ads. It is not morality; it is the law.

What is legal

  • Strip clubs: licensed bars with a show. The dancers dance; there are no sexual services. Legal.
  • Swinger clubs: private clubs for consenting adults, with nobody paid to be there. Legal.
  • Gay and liberal saunas: licensed establishments, between consenting adults. Legal.
  • Motels: licensed lodging by period. Legal and very common.
  • Sex shops and lingerie: retail, with the restriction of not exposing the content to minors. Legal.
  • Fetish and BDSM: between consenting adults, in private or licensed spaces. Legal.
  • Cabaret, burlesque, erotic dining: performance. Legal.
  • Pole dance, boudoir, stag and hen parties: services. Legal.
  • Naturism: legal on designated beaches and spaces; the Portuguese Naturism Federation has the list.

The rules that apply to everyone

Adults over 18. Establishment licence on display. No filming without consent (a privacy crime). No driving after drinking. No drugs (use is decriminalised, but not legal, and clubs throw you out).

How the guide decides

A listing only gets in if the venue has a public address, a licence for what it does and nothing in what it advertises that hints at paid sexual services. Every listing says whether it has been verified with the venue and, if so, when and how. When in doubt, the listing stays "to verify" and does not appear. When a venue changes its practice, it leaves.

Frequently asked questions

Is prostitution legal in Portugal?

Selling sex is not a crime. Profiting from someone else's prostitution (procuring) is a crime, which makes brothels, escort agencies and paid ads illegal. The guide lists none of it.

Are strip clubs legal?

Yes, as licensed bars with a show, for adults over 18. What is illegal is selling sexual services inside them.

Are swinger clubs and saunas legal?

Yes. They are establishments for consenting adults, where nobody is paid to be there. What would be illegal is charging for sexual services.

Can I be arrested for going to a motel or a club?

No. They are licensed establishments. What can get you into trouble is hiring sexual services from someone selling them on behalf of a third party, filming without consent or driving drunk.
